In New Mexico, first, second, and third DWI/DUI offenses are classified as misdemeanors. If convicted, misdemeanor offenses usually result in jail time, community service, and probation. A fourth DWI/DUI offense in New Mexico will be charged as a felony. Felony DWI/DUIs carry the more severe consequence of prison time.

DWI/DUI is a fourth degree felony in New Mexico in the event of a:

  • 4th DWI/DUI Offense – jail time is 18 months with a mandatory 6 months in jail and the maximum fine is $5,000.
  • 5th DWI/DUI Offense – jail time is 2 years with a mandatory 1 year in jail and the maximum fine is $5,000.

DWI/DUI becomes a third degree felony, a more serious charge, in the event of a:

  • 6th DWI/DUI Offense – jail time is 2.5 years with a mandatory 18 months in jail and the maximum fine $5,000.
  • 7th DWI/DUI Offense – jail time is 3 years with a mandatory 2 years in jail and the maximum fine $5,000.

Because of the seriousness of the crime, there is mandatory jail time in felony DWI/DUI convictions. Prison time is a real possibly when facing a felony DWI conviction.
